Eligibility

• You must be at least 18 years old to use the Service.

• By accessing or using the Service, you confirm that you are 18 years of age or older and have the legal capacity to enter into a binding agreement.

Types of Accounts

• Explorer Account: Explorers are users who subscribe to the Service to access video chats with Influencers, make payments, and purchase gifts for Influencers.

• Influencer Account: Influencers are users who create and offer live video content for Explorers to access. Influencers can receive gifts and payments from Explorers.

Explorer Account

• Subscription Fees: Explorers are required to pay a monthly membership fee of $6.99 (or as listed on our platform) to access the video chat service with Influencers. The fee will be billed automatically on a recurring basis. Subscription fees are non-refundable except as required by law.

• Payments and Gifting: Explorers may make additional payments to Influencers, including purchasing gifts, via the Service. These payments are processed through the platform, and Explorers will be charged for the full value of any gifts or other monetary contributions sent to Influencers.

• Billing Cycle: The subscription fee will be billed on a monthly basis. You may cancel your subscription at any time via your account settings. If you cancel, your subscription will remain active until the end of the current billing cycle, and no refunds will be provided.

Influencer Account

• Processing Fee: Influencers are subject to a one-time processing fee of $12.99 to set up their account and begin offering content. The processing fee is non-refundable.

• Payouts to Influencers: Influencers receive 80% of the total payments made by Explorers to them, including gifts and other monetary contributions. Payments to Influencers are held for 24 hours before being processed. During this 24-hour hold period, any chargebacks or fraud concerns may be assessed.

• No Refunds: Once a gift or payment is made by an Explorer, it is non-refundable. Influencers will not be required to return any gifts or payments after they are processed, except in cases of fraud or violations of the Terms of Service.

Payments and Transactions

• Payment Methods: All payments made by Explorers to Influencers or for gifts will be processed securely through third-party payment processors. Explorers must provide valid payment information to complete transactions.

• Currency and Fees: All transactions are processed in the currency specified in your account settings. Any applicable transaction fees, such as currency conversion or processing fees, will be outlined before payment is completed.

Disclaimers and Limitation of Liability

• No Guarantee of Success or Earnings: The Service is provided 'as is,' and we make no guarantees regarding the success or earnings of either Explorers or Influencers. Any payments or gifts made through the Service are voluntary and do not constitute any guarantee of return or compensation.

• No Liability for Loss or Damages: HBB is not liable for any loss, damage, or injury arising from your use of the Service, including any interactions with other users (Explorers or Influencers), transactions, or gifts. This includes, but is not limited to, loss of data, account suspension, or financial losses incurred through the Service.

• Service Availability: We do not guarantee uninterrupted service or access to the platform. We are not liable for any disruptions, errors, or downtime, including issues with payment processing or the availability of Influencers.

User Responsibilities

• Content and Conduct: Users must comply with all applicable laws and regulations and agree not to engage in any unlawful, fraudulent, or disruptive behavior when using the Service.

• Prohibited Content: Users must not engage in activities that harm, harass, or defraud other users. This includes, but is not limited to, abusive behavior, hate speech, or sharing illegal content. Any violation of this policy may result in suspension or termination of your account.

Termination and Suspension

• We reserve the right to suspend or terminate any account at our discretion, including for violations of these Terms. If your account is suspended or terminated, any outstanding payments or gifts may be forfeited, and you will not be refunded any fees paid.

Privacy and Data Security

• We are committed to protecting your personal information. Our Privacy Policy outlines how we collect, use, and protect your data. By using the Service, you agree to the collection and use of your data as described in our Privacy Policy.

Modifications to the Service or Terms

• We may update or modify these Terms at any time. Any changes will be posted on our website or communicated through other means, and they will be effective immediately upon posting. By continuing to use the Service after such changes, you agree to the updated Terms.

Governing Law and Dispute Resolution

• Agreement to these Terms of Service is governed by the laws of Hong Kong without reference to any conflict of laws principles that would require the application of the laws of any other jurisdiction. You irrevocably consent to the personal jurisdiction of the courts located in Hong Kong, for any suit or action arising from or related to this Agreement and waive any right you may have to object to the venue of such courts. You further agree that these courts will have exclusive jurisdiction over any such suit or action initiated by you against HBB.

• Any dispute, controversy, difference, or claim arising out of or relating to this contract, including the existence, validity, interpretation, performance, breach, or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to it shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted.
